1. Agreement to These Terms

These Terms of Service, together with any policies referenced in them, govern your access to and use of Constell8tion, including our mobile application, website, waitlist, matchmaking tools, quiz experiences, community features, educational content, paid subscriptions, events, communications, and related services.

Constell8tion is a dating, relationship, and community platform designed for adults exploring polyamory, ethical non-monogamy, open relationships, relationship education, and modern love dynamics. By creating an account, accessing the app, using our services, joining the waitlist, purchasing paid features, or otherwise interacting with Constell8tion, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use Constell8tion.

2. Definitions

For clarity, the following terms have the meanings described below.

3. Eligibility and Adult-Only Use

Constell8tion is intended only for adults. You must be at least 18 years old and legally able to enter into a binding agreement to use the Services. If the age of majority or legal age for dating-related services is higher in your jurisdiction, you must meet that higher age requirement.

By using Constell8tion, you represent and warrant that you meet these eligibility requirements, that you are not prohibited from using the Services under applicable law, and that you have not previously been suspended or removed from Constell8tion unless we have expressly authorized your return.

We may require age, identity, phone, email, photo, selfie, or other verification checks at our discretion. We may refuse, suspend, restrict, or terminate access if we believe a user is underage, misrepresenting identity, violating these Terms, or creating a safety risk.

4. Nature of the Services

Constell8tion provides tools for discovery, connection, relationship education, community, compatibility reflection, and communication. We do not guarantee that you will find matches, enter a relationship, experience a particular result, or meet people who satisfy your preferences.

Our matching tools, archetype quizzes, compatibility insights, educational materials, and AI-assisted features are intended for informational, entertainment, personal reflection, and relationship education purposes. They do not constitute therapy, medical advice, legal advice, financial advice, professional counseling, psychological diagnosis, or a guarantee of compatibility.

You are solely responsible for your decisions, communications, meetings, relationships, boundaries, agreements, and interactions with other users, both online and offline.

5. Account Registration and Security

To use certain features, you may need to create an account and provide accurate information. You agree to keep your account information current, protect your login credentials, and notify us promptly of unauthorized access or suspected security issues.

You are responsible for all activity that occurs under your account unless the activity results from Constell8tion's failure to use reasonable security measures.

6. User Profiles, Matching, and Discovery

Your profile may include information about your identity, preferences, relationship style, photos, interests, location, compatibility preferences, archetype results, and other details you choose to share. You are responsible for the accuracy and appropriateness of your profile.

You agree not to create a false identity, impersonate another person, misrepresent your relationship status, misstate your intentions, use misleading photos, conceal material safety-related information, or present yourself in a way that is deceptive or harmful to other users.

Constell8tion may display your profile to other users based on your settings, matching preferences, location, activity, paid features, app algorithms, and safety controls. We may limit, filter, remove, or restrict profile visibility if we believe doing so is necessary to protect users, comply with law, improve service quality, or enforce these Terms.

7. Consent, Ethical Conduct, and Relationship Responsibility

Constell8tion is built around modern, intentional, and ethical relationship dynamics. All users are expected to engage with honesty, consent, respect, and emotional responsibility.

Constell8tion does not monitor or enforce private relationship agreements between users unless conduct violates these Terms, our community standards, safety policies, or applicable law.

8. User Content and License to Constell8tion

You retain ownership of your User Content. By submitting, uploading, displaying, messaging, posting, or otherwise providing User Content through the Services, you grant Constell8tion a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to host, store, reproduce, display, transmit, adapt, moderate, remove, and otherwise use your User Content as necessary to operate, improve, promote, secure, and provide the Services.

This license allows us to display your profile, deliver messages, create previews, process reports, moderate content, provide matching, operate community features, troubleshoot issues, and perform related service functions. The license ends when your User Content is deleted from our systems, except to the extent retention is necessary for legal, safety, backup, enforcement, audit, or legitimate business purposes.

You represent and warrant that you own or have the necessary rights to your User Content and that your User Content does not violate the rights of others, applicable law, or these Terms.

9. Prohibited Content and Conduct

You agree not to engage in content or conduct that is illegal, harmful, exploitative, deceptive, abusive, unsafe, or inconsistent with the purpose of Constell8tion.

We may remove content, limit visibility, issue warnings, suspend accounts, terminate accounts, block devices, report conduct to authorities, or take other action when we believe these Terms have been violated.

10. Safety, Offline Meetings, and User Responsibility

Constell8tion may provide safety tools, reporting features, profile controls, educational content, verification options, or moderation practices, but we cannot guarantee user conduct, identity, intentions, compatibility, or safety.

You are responsible for using judgment when interacting with other users. If you choose to meet someone offline, you should take reasonable precautions, including meeting in a public place, telling a trusted person where you are going, arranging your own transportation, protecting personal information, and respecting all boundaries and consent.

You acknowledge that dating and relationship interactions involve risks, including emotional, physical, financial, privacy, and safety risks. To the fullest extent permitted by law, Constell8tion is not responsible for the conduct of users online or offline.

11. Reporting, Blocking, and Moderation

You may report users, content, messages, or behavior that you believe violates these Terms or creates a safety concern. You may also block users through available app tools.

Constell8tion may review reports, content, messages, account information, device information, and activity logs where necessary to investigate potential violations, maintain safety, enforce policies, or comply with law. We may take action at our discretion, including warnings, content removal, account restrictions, suspension, termination, visibility limits, or referrals to law enforcement when appropriate.

We are not obligated to monitor all content or resolve all user disputes. We may not disclose specific moderation outcomes where doing so would compromise privacy, safety, legal obligations, or platform integrity.

12. Paid Services, Subscriptions, and Purchases

Constell8tion may offer Paid Services, including premium subscriptions, paid reports, boosts, event access, courses, premium matching features, or in-app purchases. Prices, features, billing periods, renewal terms, cancellation rules, and refund availability will be disclosed at or before purchase.

If payment fails, we may suspend or limit access to Paid Services. You are responsible for any taxes, fees, or charges associated with your purchase unless otherwise stated.

13. Beta Features, Waitlists, and Early Access

Constell8tion may offer beta features, waitlists, early access programs, testing groups, experiments, and preview releases. These features may be incomplete, subject to change, unavailable at times, or discontinued without notice.

Participation in beta or early access programs does not guarantee permanent access, specific features, future pricing, account approval, matchmaking success, or commercial availability. Feedback you provide may be used by Constell8tion without compensation or obligation to you.

14. Community Features and Events

Constell8tion may provide community discussions, group spaces, educational content, workshops, events, social features, or off-platform community links. You agree to participate respectfully and comply with all posted community guidelines, event rules, and safety expectations.

We may remove users from communities or events if we believe their behavior is disruptive, unsafe, unlawful, harassing, discriminatory, or inconsistent with these Terms. Community spaces are not a substitute for professional advice, emergency services, therapy, legal counsel, medical care, or crisis support.

15. Intellectual Property

Constell8tion and its content, branding, design, software, features, algorithms, names, logos, graphics, icons, videos, text, educational materials, archetype frameworks, quiz structures, interface elements, and related materials are owned by Constell8tion or its licensors and are protected by intellectual property laws.

You may not copy, modify, distribute, sell, lease, reverse engineer, scrape, reproduce, create derivative works from, publicly display, or exploit any part of the Services except as expressly permitted by these Terms or by written permission from Constell8tion.

Nothing in these Terms grants you ownership of Constell8tion's intellectual property.

16. Copyright and Intellectual Property Complaints

If you believe content on Constell8tion infringes your intellectual property rights, you may contact us at admin@constell8tion.com with information sufficient to identify the content, your rights, your contact information, and a statement that you have a good-faith belief that the use is unauthorized.

We may remove allegedly infringing content, restrict accounts, or take other action as appropriate. Users who repeatedly infringe intellectual property rights may be suspended or terminated.

17. Privacy

Our collection, use, sharing, and protection of personal information is described in our Privacy Policy. By using the Services, you acknowledge that you have read the Privacy Policy.

Because Constell8tion involves dating, relationships, polyamory, identity, and potentially sensitive preferences, you should carefully consider what information you choose to share in profiles, messages, communities, and offline interactions.

18. Third-Party Services

Constell8tion may include links, integrations, content, or services provided by third parties, including app stores, payment processors, social networks, analytics providers, community platforms, event platforms, verification vendors, cloud hosting providers, and external websites.

We do not control third-party services and are not responsible for their content, policies, security, availability, or practices. Your use of third-party services may be governed by separate terms and privacy policies.

19. Artificial Intelligence, Quizzes, and Compatibility Tools

Constell8tion may offer AI-assisted features, compatibility tools, quiz results, archetype outputs, prompts, recommendations, conversation guides, or personalized educational content. These features may generate insights based on information you provide or activity within the Services.

You understand and agree that these features may not always be accurate, complete, appropriate, or suitable for your circumstances. You should not rely on AI outputs, quiz results, or compatibility suggestions as professional advice or as a substitute for personal judgment, communication, consent, therapy, legal advice, medical advice, or emergency assistance.

Constell8tion may modify or discontinue these features at any time.

20. Service Availability and Changes

We may modify, suspend, discontinue, update, test, limit, or remove any part of the Services at any time. We do not guarantee that the Services will be uninterrupted, error-free, secure, available in every location, or compatible with every device.

We may perform maintenance, release updates, change features, adjust algorithms, revise pricing, alter matching systems, or discontinue offerings. Where required, we will provide reasonable notice of material changes affecting paid users.

21. Account Suspension and Termination

You may stop using Constell8tion at any time and may request account deletion through app settings or by contacting support.

We may suspend, restrict, or terminate your account or access to the Services at any time if we believe you have violated these Terms, created risk for other users, provided false information, engaged in illegal or abusive conduct, misused the platform, caused potential legal exposure, or otherwise acted inconsistently with the purpose of Constell8tion.

Upon termination, your right to use the Services ends immediately. Certain provisions of these Terms will survive termination, including provisions related to intellectual property, licenses, disclaimers, limitations of liability, indemnification, dispute resolution, and any obligations that by their nature should survive.

22. Disclaimers

To the fullest extent permitted by law, the Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, statutory, or otherwise.

Constell8tion does not warrant that the Services will be uninterrupted, secure, error-free, accurate, reliable, compatible, or available at any particular time or location. We do not warrant the conduct, identity, intentions, compatibility, honesty, safety, or reliability of any user.

Constell8tion is not responsible for relationship outcomes, dating experiences, offline meetings, user decisions, emotional distress, personal disputes, compatibility results, or conduct by users or third parties except where liability cannot be excluded by law.

23. Limitation of Liability

To the fullest extent permitted by law, Constell8tion, its owners, officers, directors, employees, contractors, affiliates, service providers, licensors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, including lost profits, lost data, emotional distress, reputational harm, personal injury, relationship harm, or loss of goodwill arising from or related to your use of the Services.

In no event shall Constell8tion be held liable for damages exceeding the amount you paid to Constell8tion for the Services in the twelve (12) months preceding the claim.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

24. Indemnification

You agree to indemnify and hold Constell8tion harmless against any claims that arise from your use of the Constell8tion app or platform. To the fullest extent permitted by law, this includes any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from or related to your User Content, your interactions with other users, your violation of these Terms, your violation of law, or your infringement of any rights of another person or entity.

25. Dispute Resolution, Arbitration, and Class Action Waiver

25.1 Informal Resolution. Before filing a formal claim, you agree to first contact us at admin@constell8tion.com and provide a brief written description of the dispute, the relief sought, and your contact information. We will attempt to resolve the dispute informally within sixty (60) days. Both parties agree to negotiate in good faith during this period.

25.2 Agreement to Arbitrate. If a dispute is not resolved informally, you and Constell8tion agree that any claim, dispute, or controversy arising out of or relating to these Terms or the Services (a “Claim”) will be resolved exclusively through final and binding arbitration, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. This agreement to arbitrate is intended to be broadly interpreted and includes claims based on contract, tort, statute, fraud, misrepresentation, or any other legal theory.

25.3 Arbitration Rules and Administration. The arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect. The arbitrator, not any court, will have exclusive authority to resolve any dispute relating to the interpretation, applicability, or enforceability of this arbitration agreement, except that challenges to the enforceability of the class action waiver in Section 25.4 will be decided by a court.

25.4 Class Action and Jury Trial Waiver. You and Constell8tion agree that each may bring Claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. Unless both parties agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a class or representative proceeding. If this class action waiver is found unenforceable as to a particular Claim or remedy, that Claim or remedy (and only that Claim or remedy) will be severed and may proceed in court, while the remainder of this arbitration agreement remains in full force. Both parties knowingly and voluntarily waive any right to a trial by jury.

25.5 Opt-Out Right. You may opt out of this arbitration agreement by sending written notice to admin@constell8tion.com within thirty (30) days of the date you first agree to these Terms. Your notice must include your name, the email address associated with your account, and a clear statement that you wish to opt out of arbitration. If you opt out, neither you nor Constell8tion will be required to arbitrate, and Section 25.4's class action waiver will not apply to your Claims, but all other provisions of these Terms, including Section 25.8, remain in effect.

25.6 Location and Procedure. Unless you and Constell8tion agree otherwise, arbitration will be conducted in Sheridan County, Wyoming, or may be conducted by telephone, videoconference, or through written submissions where permitted by the AAA rules. Each party will bear its own attorneys' fees and costs unless the arbitrator determines a claim was frivolous or the AAA rules or applicable law provide otherwise, and fee arrangements will follow the AAA Consumer Arbitration Rules, including any consumer-protective limits on filing fees.

25.7 Governing Law. This agreement and any dispute arising from it or from the Services will be governed by the laws of the State of Wyoming, without regard to conflict-of-law principles, except to the extent preempted by the Federal Arbitration Act.

25.8 Venue for Non-Arbitrable Matters. Any Claim not subject to arbitration under this Section, including small claims actions or Claims where you have validly opted out, will be brought exclusively in the state or federal courts located in Sheridan County, Wyoming, and you consent to personal jurisdiction there.

25.9 Savings Clause. If any part of this Section 25 is found to be unenforceable, the remainder will remain in effect, and an unenforceable provision will be modified to the minimum extent necessary to make it enforceable. Nothing in this Section limits any right that cannot be waived under applicable consumer protection law.

26. App Store Terms

If you download Constell8tion through the Apple App Store, Google Play, or another app marketplace, your use may also be subject to that marketplace's terms and policies. The app store provider is not responsible for Constell8tion's content, support, claims, maintenance, or operation except as required by its own terms or applicable law.

If there is a conflict between these Terms and the applicable app store terms, the app store terms may control only to the extent required for your use of that app store.

27. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will revise the “Last Updated” date above. If changes are material, we may provide additional notice through the app, website, email, or other appropriate means.

Your continued use of the Services after updated Terms become effective means you accept the updated Terms. If you do not agree to the updated Terms, you must stop using the Services.

28. Electronic Communications

By using Constell8tion, you agree to receive communications from us electronically, including emails, in-app messages, push notifications, SMS messages where you consent, and notices posted through the Services. Electronic communications satisfy any legal requirement that communications be in writing unless applicable law requires another form.

You may opt out of marketing communications, but we may still send transactional, safety, account, legal, or service-related communications.

29. Miscellaneous

These Terms, together with the Privacy Policy and any additional terms referenced or presented for specific features, constitute the entire agreement between you and Constell8tion regarding the Services.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of our right to do so later. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, restructuring, sale of assets, or by operation of law.
